GotTunnel.com Terms of Use

1.) Description of Service. GotTunnel.com is a free, time sharing application from GotTunnel.com (the "Service"). You understand and agree that the Service is provided on an AS IS and AS AVAILABLE basis. GotTunnel.com disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Service. GotTunnel.com also reserves the right to modify, suspend or discontinue the Service with or without notice at any time and without any liability to you.

2.) Personal Use. The Service is made available to you for your personal use only. Due to the Children's Online Privacy Protection Act of 1998 (which is available at http://www.ftc.gov/ogc/coppa1.htm), you must be at least thirteen (13) years of age to use this Service. You must provide current, accurate identification, contact, and other information that may be required as part of the registration process and/or continued use of the Service. You are responsible for maintaining the confidentiality of your Service password and account, and are responsible for all activities that occur thereunder. GotTunnel.com reserves the right to refuse service to anyone at any time without notice for any reason.

3.) Representations and Warranties. You represent and warrant that (a) all of the information provided by you to GotTunnel.com to participate in the Services is correct and current; and (b) you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder.

4.) Indemnification. You agree to hold harmless and indemnify GotTunnel.com and its affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, GotTunnel.com will provide you with written notice of such claim, suit or action.

5.) Indemnification. You expressly agree that use of GotTunnel.com is at the your sole risk. Neither GotTunnel.com, its affiliates, officers, agents nor any of their respective employers, employees, agents, third party content providers or licensors warrant that GotTunnel.com will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of GotTunnel.com, or as to the accuracy, reliability or content of any information, or service provided through GotTunnel.com.

6.) Adding Content. By publishing or submitting any content including (but not limited to): posting of Tunnel Times, Tunnel Time Requests, articles, stories and photographs to any part of GotTunnel.com you give permission that such content may be used at the sole discretion of GotTunnel.com anywhere else on the site, for any purpose, in its original or edited form, at any time in the future. Content will not be sold without permission of the original author or owner.

7.) Copyright and Trademark Notices. The images, text, screens, and web pages appearing on the Internet sites within the Sites are owned by us, or others, as indicated and are protected by copyright laws. You agree not to copy, display, distribute, download, license, sub-license, modify, publish, repost, reproduce, reuse, sell, transmit, create a derivative work from or otherwise use for public or commercial purposes, the information and materials on the Sites, except as provided in Agreement, without our express written permission. Unless otherwise noted, all other trademarks, service marks, and logos used on the Sites are the trademarks, service marks or logos of GotTunnel.com, or others as indicated.
